1. Scope

These Terms and Conditions ("Terms") set out the basis on which W89 GmbH, Cham, Switzerland ("we", "us", or "our") makes the website willen.org (the "Website") available. WILLEN:ORG is an initiative of W89 GmbH.

They apply to your use of the Website so far as the law allows terms of this kind to apply without a separate agreement. Merely opening a page does not constitute the conclusion of a contract and imposes no obligation on you. If you do not wish these Terms to apply, do not use the Website.

Where you agree something with us separately, for example by email, that agreement governs and these Terms do not.

3. Description of Services

WILLEN:ORG is a pay-it-forward initiative of W89 GmbH, based in Cham, Switzerland. The Website itself is a single page carrying our name and one line of tagline. It describes no services and sets out no terms of any support.

All information on the Website is provided for general informational purposes only and does not constitute a legally binding offer of services, an invitation to negotiate, or professional advice of any kind.

W89 GmbH is a commercial company registered in Switzerland. WILLEN:ORG is not a charity, not a foundation, and not a tax-exempt organisation. Nothing on the Website constitutes a claim to charitable status, and contributions made to us are not tax-deductible donations.

4. Support

Any support we provide is given voluntarily and at our sole and absolute discretion. There is no entitlement to receive it, the Website publishes no criteria for it, and we may refuse, discontinue, or modify it at any time without providing reasons.

Whether and on what terms we can help is discussed individually by email. Anything agreed there is agreed separately and is not governed by the Website.

5. Intellectual Property

The text, the wordmark, the logo, the design, the layout and the arrangement of this Website are owned by W89 GmbH and are protected by Swiss and international intellectual property law, in particular the Swiss Federal Act on Copyright and Related Rights (CopA, SR 231.1).

Not all material served on this Website belongs to us. The two typefaces used on this Website, Raleway and IBM Plex Mono, are the property of their respective authors and are used under the SIL Open Font License 1.1. The licence text is available at https://willen.org/fonts-license.txt. The site is built with open-source software that remains the property of its authors under its own licences.

No part of the Website may be reproduced, distributed, modified, publicly displayed, or otherwise used without our prior written consent, unless expressly permitted by mandatory law or by the licence covering the material in question.

6. Permitted Use

You agree to use the Website only for lawful purposes and in compliance with these Terms and all applicable laws. In particular, you shall not:

  • Use the Website in a manner that could damage, disable, overburden, or impair it
  • Attempt to gain unauthorised access to any part of the Website or its underlying systems
  • Use automated means to access the Website in a way our robots.txt does not permit, or at a rate or volume that could impair its availability for others. Ordinary crawling and indexing within the limits of our robots.txt is expressly permitted, including by AI systems; see our llms.txt
  • Transmit any malicious software, viruses, or harmful code
  • Use the Website to infringe on the rights of any third party
  • Collect or harvest personal data of other users

7. Communication via Email

The Website facilitates communication via email (mailto links). By contacting us, you acknowledge that:

  • Standard email is not a fully secure means of communication
  • We are not responsible for the confidentiality or integrity of data transmitted via third-party email services
  • You should not include particularly sensitive personal data (e.g. health data, financial account details) in your messages unless appropriate security measures are in place

We will process the data you provide in accordance with our Privacy Policy.

8. Disclaimer of Warranties

The Website is provided on an "as is" and "as available" basis. To the maximum extent permitted by Swiss law, we make no representations or warranties of any kind, whether express, implied, or statutory, including but not limited to:

  • Warranties of merchantability or fitness for a particular purpose
  • That the Website will be uninterrupted, timely, secure, or error-free
  • That the content is accurate, complete, reliable, or up to date
  • That the Website is free of viruses or other harmful components

Any reliance on the content of the Website is at your own risk.

9. Limitation of Liability

We are liable without limitation for damage caused by intent or gross negligence.

Liability for slight negligence is excluded to the extent permitted by Art. 100 of the Swiss Code of Obligations (OR). An advance agreement excluding liability for unlawful intent or gross negligence is void under Swiss law, and no such exclusion is made here.

Within that limit, we are in particular not liable for:

  • Indirect, incidental, special or consequential damage
  • Loss of profits, data, goodwill, or other intangible losses
  • Damage arising from your use of or inability to use the Website

This limitation applies equally to persons acting on our behalf (Art. 101 para. 2 OR).

Liability that cannot be excluded by agreement under mandatory Swiss law remains unaffected, and nothing in these Terms limits the rights you have as a consumer under mandatory law.

10. Indemnity

If you use the Website in breach of Section 6 or in breach of applicable law, and a third party brings a claim against us as a result, you will indemnify us against that claim and against the reasonable legal costs of defending it.

We will notify you of any such claim without undue delay, will not settle it without your consent, and will give you the opportunity to conduct the defence yourself.

This Section does not apply to the extent the claim arises from our own intent or gross negligence, and it does not restrict any rights you have as a consumer under mandatory law.

11. Suspension of Access

We may block or rate-limit access to the Website, in whole or in part, where that is necessary to protect its availability, integrity or security, in particular in response to attacks or to automated access in breach of Section 6.

We will limit any such measure to what is necessary and lift it once the reason for it has ended.

This Website requires no account and stores nothing about you, so no data of yours is affected by such a measure and there is nothing to delete or hand back. If you believe access was blocked in error, please write to info@willen.org.

The Website may contain hyperlinks to third-party websites. These links are provided for convenience only. We have no control over the content, privacy practices, or availability of linked websites and accept no responsibility for them.

If modification is not possible, the provision shall be deemed severed from these Terms. The remaining provisions shall continue in full force and effect.

15. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the substantive laws of Switzerland, excluding its conflict of laws provisions and excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

Any disputes arising out of or in connection with these Terms or the use of the Website shall be subject to the exclusive jurisdiction of the competent courts at the registered seat of W89 GmbH in Cham, Canton of Zug, Switzerland.

Mandatory statutory provisions regarding the jurisdiction at the consumer's domicile remain reserved.
